1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of The Automator, available at theautomator.ai (the "Service"), operated by newdigi ("we," "us," or "our"), a digital marketing agency based in Vancouver, British Columbia, Canada.
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, do not use the Service.
2. About The Automator
The Automator is an AI-powered adoption advisor that helps businesses identify opportunities for AI and automation in their operations. The Service includes:
- Business assessment questionnaires
- AI-generated recommendations and roadmaps
- An AI Coach for interactive guidance
- Automation builds and implementation support
- Knowledge resources on AI tools and workflows
The Service uses artificial intelligence, including Anthropic's Claude API, to analyze your inputs and generate personalized recommendations.
3. Account Registration & Responsibility
To access most features of the Service, you must create an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Keep your login credentials secure and confidential
- Notify us immediately if you suspect unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
You must be at least 18 years old to use the Service. We reserve the right to refuse service, terminate accounts, or remove content at our discretion.
Each account is for a single user. Sharing login credentials with multiple people is not permitted without a team or enterprise plan.
4. Subscriptions & Billing
The Automator offers both free and paid tiers. Paid subscriptions are billed monthly through Stripe, our third-party payment processor.
Pricing
Current subscription plans and pricing are displayed on the Service. We reserve the right to change pricing with at least 30 days' notice. Price changes will not affect your current billing cycle.
Billing Cycle
Subscriptions are billed on a recurring monthly basis. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date. We do not provide prorated refunds for partial months.
Refunds
Refund requests are handled on a case-by-case basis. If you believe you were charged in error, contact us within 14 days of the charge.
Payment Security
All payment information is processed and stored by Stripe. We do not store your credit card details on our servers. Stripe's privacy policy and terms apply to your payment transactions.
5. AI-Generated Content Disclaimer
Important: Please read this section carefully.
The recommendations, roadmaps, and guidance provided by The Automator are generated by artificial intelligence and are for informational purposes only. They do not constitute professional business, legal, financial, or technical advice.
Specifically, you acknowledge and agree that:
- AI outputs may be inaccurate. While we strive for quality, AI-generated content can contain errors, omissions, or outdated information. You should independently verify any recommendations before acting on them.
- Results are not guaranteed. Implementation of AI or automation tools carries inherent risks. We make no guarantees about the outcomes, cost savings, or business improvements that may result from following our recommendations.
- You are responsible for your decisions. Any business decisions you make based on the Service's output are entirely your own responsibility. We strongly recommend consulting with qualified professionals (legal, financial, IT) before making significant operational changes.
- AI Coach conversations are informational. The AI Coach feature provides general guidance, not personalized professional consulting. It should supplement, not replace, expert advice.
- Tool and vendor recommendations are suggestions. When the Service recommends specific third-party tools or services, we are not endorsing them and have no responsibility for their performance, pricing, or suitability for your use case.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Submit false, misleading, or fraudulent information
- Attempt to reverse-engineer, decompile, or extract the source code of the Service
- Interfere with or disrupt the Service, servers, or networks
- Scrape, crawl, or use automated tools to extract data from the Service without permission
- Use the Service to develop a competing product
- Attempt to gain unauthorized access to other users' accounts or data
- Upload malicious code, viruses, or harmful content
- Resell, sublicense, or redistribute the Service or its outputs without authorization
- Use the Service in any way that could harm minors
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.
7. Intellectual Property
Our Property
The Service, including its design, code, branding, assessment frameworks, scoring models, workflow templates, and documentation, is owned by newdigi and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
AI-Generated Outputs
Recommendations, roadmaps, and other outputs generated for you by the Service are provided for your use. You may use these outputs in your business operations. However, the underlying models, prompts, and methodologies used to generate those outputs remain our intellectual property.
Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, worldwide license to use, modify, and incorporate that feedback into the Service without any obligation to you.
8. Data Ownership
You own your data. All business information, assessment responses, and other data you provide to the Service remains your property. We do not claim ownership of your input data.
You grant us a limited license to use your data solely for the purpose of operating and improving the Service, including:
- Generating your personalized recommendations and roadmaps
- Processing your data through AI models to deliver the Service
- Analyzing aggregated, anonymized usage patterns to improve the Service
We will not sell your individual data to third parties. See our Privacy Policy for details on how your data is handled.
You may request export or deletion of your data at any time by contacting us.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
- In no event shall newdigi, its owner, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service.
- Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or CAD $100, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the greatest extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless newdigi and its owner, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any business decisions you make based on the Service's outputs.
11. Termination
By You
You may close your account at any time by contacting us. If you have an active subscription, cancellation will take effect at the end of your current billing period.
By Us
We may suspend or terminate your account at any time if:
- You violate these Terms
- Your use of the Service poses a security risk
- We are required to do so by law
- We discontinue the Service (with reasonable notice)
Effect of Termination
Upon termination, your right to access the Service ends immediately. We will retain your data for 30 days after termination, during which you may request an export. After 30 days, your data will be permanently deleted unless retention is required by law.
12. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be resolved in the courts located in Vancouver, British Columbia, Canada. You consent to the exclusive jurisdiction of those courts.
Before initiating any formal legal proceedings, both parties agree to attempt to resolve disputes informally by contacting each other directly. If a dispute is not resolved within 30 days of informal contact, either party may proceed with formal resolution.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page
- Notify you by email or through a prominent notice on the Service
- For material changes, provide at least 14 days' notice before the new terms take effect
Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree with the updated Terms, you should stop using the Service and close your account.
